1. General Information

These Terms and Conditions govern all bookings and services offered by DARSURFANA ("we," "us," or "our"), including surf lessons, accommodation, yoga sessions, and surf packages. By making a booking, you agree to these terms.

1.1 Our Services

We offer surf lessons, yoga sessions, accommodation, and surf holiday packages in Agadir, Morocco. All services depend on availability and comply with these Terms.

2. Booking and Payment

2.1 How to Book

Bookings can be made via our website, email, or phone. Your booking is confirmed once you receive a written confirmation email from us.

2.2 Payment Terms

• A non-refundable deposit of 30% of the total booking value is required to secure your reservation.
• The remaining balance must be paid upon arrival unless otherwise agreed in writing.
• For bookings made 7 days or less before the arrival date, full payment is required at the time of booking.
• Payments may be made by bank transfer, credit card, PayPal, cash, or other approved payment methods.

2.3 Prices

All prices are in EUR or MAD, including taxes unless otherwise stated. Prices may change until your booking is confirmed.

3. Cancellation Policy

3.1 Cancellation by Customer

• The deposit is non-refundable
• Cancellations made more than 7 days before arrival will not incur any additional charges beyond the loss of the deposit.
• For bookings made within 7 days of arrival and paid in full, cancellations are non-refundable.
• No-shows, unused services, and early departures are non-refundable.

3.2 Cancellation by DARSURFANA

We may cancel your booking due to:

• Force majeure (natural disasters, pandemics, government restrictions)
• Insufficient group numbers
• Unexpected operational issues

In such cases, you may choose between a full refund or rescheduling to another date.

4. Changes and Modifications

4.1 Changes by Customer

• Changes are subject to availability
• €25 fee for changes made more than 30 days before arrival
• Changes within 30 days will be treated as a cancellation

4.2 Changes by DARSURFANA

If we need to make major changes to your booking, you can:

• Accept the new arrangements
• Cancel for a full refund
• Reschedule to another available date

5. Accommodation

Early or late check-in/check-out may be arranged with advance notice and may incur additional fees.

• Accommodation is for registered guests only
• A refundable damage deposit may be required upon arrival
• Guests must follow house rules at all times
• Serious violations may result in immediate termination without refund

6. Surf Lessons and Activities

6.1 Requirements

• Minimum age: 8 years old
• Basic swimming ability required
• Participants under 18 need parental consent

6.2 Lesson Details

• All surf lessons are led by certified instructors
• Schedules depend on tides, weather, and ocean conditions
• Equipment included (surfboard and wetsuit)
• Damage to equipment due to misuse may incur additional charges

7. Travel Insurance

Your insurance should cover:

• Trip cancellation and interruption
• Medical care and hospitalization
• Emergency evacuation
• Personal belongings and luggage
• Surf and adventure activities

We are not responsible for any costs incurred if adequate insurance is not purchased.

8. Health and Safety

• You must inform us of any medical conditions, allergies, or disabilities
• We follow all Moroccan health and safety regulations
• Guests must provide an emergency contact person
• First aid equipment is available on-site

9. Passport, Visa & Entry Requirements

You are responsible for ensuring you have:

• A valid passport (at least 6 months validity from departure date)
• Appropriate visa if required for your nationality
• Any required vaccinations or health documentation

10. Liability

• DARSURFANA maintains all necessary liability insurance
• We are not responsible for services provided by third parties
• Maximum liability (excluding personal injury or death) is limited to 3× the total booking value
• You are responsible for your personal belongings and any damages you cause
• Surf and water sports carry inherent risks; participation is at your own risk

11. Complaints

If you have any concerns during your stay, please inform us immediately so we can resolve the issue promptly.

Formal complaints must be submitted in writing via email within 28 days of your departure date.

12. Privacy Policy

We are committed to protecting your personal data. Information collected is used solely for booking management, communication, and service improvement. We do not share your data with third parties except when necessary for operational purposes (e.g., payment processors, insurance providers).

13. Applicable Law

These Terms and Conditions are governed by Moroccan law. Any disputes arising from these terms will fall under the jurisdiction of Moroccan courts.

14. General Provisions

• These Terms, together with your booking confirmation, constitute the complete agreement
• If any clause is found invalid, the remaining terms remain in effect
• Bookings cannot be transferred to another person without our written approval
• We reserve the right to update these Terms; the current version is always available on our website

15. Acknowledgment

By making a booking with DARSURFANA, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
